Vestian, its subsidiaries and branch operations hereinafter referred as 'we', 'us' or 'our' is committed to respect your privacy and choices. The statement highlights our privacy practices regarding Personal Information that we collect and store about you through this website and also those Personal Information that you provide us while participating in our events and campaigns.

The entity responsible for Personal Information collected through www.vestian.com is Vestian Global Workplace Services, LLC, headquartered in Chicago, Illinois, USA. Where Personal Information is processed by our India operations, the responsible entity is Vestian Global Workplace Services Private Limited.

Privacy Statement

1. Personal Information we collect and process and how we use it

a. Personal Information that we process

For the purposes of this privacy statement, 'Personal Information' is any data which relates to an individual who may be identified from that data, or from a combination of a set of data, and other information which is in possession of Vestian.

In general, you may browse our website without providing any Personal Information about yourself. However, we collect certain information such as:

- Information that you provide via our website, including information you provide when you register on our website e.g. name, email address, postal address, designation, company, country and telephone number;

- Information about your computer and about your visits to and use of this site, such as your Internet Protocol (IP) address, demographics, your computers' operating system, and browser type and information collected via cookies

- information we receive from third-party providers, including visitor-identification and business-contact data providers such as RB2B and ZoomInfo, and from publicly available professional sources; and
‍
- Cookie related details are provided in Section 4 below

b. Use of your Personal Information

We use your Personal Information for the following purposes:

  • to provide better usability, troubleshooting and site maintenance;
  • to understand which parts of the website are visited and how frequently;
  • to create your user ID; to identify you once you register on our website by filling an online form;
  • to contact you and respond to your questions or requests;to provide access to desirable content based on your preferences; and
  • to process job application and alumni related requests, more details about which are available on corresponding portals of this website.
  • to identify prospective clients and carry out business development and marketing, from which you can opt out at any time.

c. Legal basis of the processing

We process your Personal Information when it is necessary for the performance of a contract to which you are the party or in order to take steps at your request prior to entering into a contract. This applies in any case where we provide services to you pursuant to a contract, such as when you use our website or process your registration on the website. If you do not provide the Personal Information that we need in order to provide our services, we will not be able to provide our services to you. We process your Personal Information for the performance of a contract in the following circumstances:

  • to provide better usability, troubleshooting and site maintenance; and
  • to create your user ID.
  • We process your Personal Information when it is necessary for the purposes of a legitimate interest pursued by us or a third party (when these interests are not overridden by your data protection rights). This applies in the following circumstances:

    • to contact you and respond to your questions or requests;
    • to understand which parts of the website are visited and how frequently; and

d. Vestian VProjects Tool Android App

  • Vestian collects your email account information from the device for authentication purpose. The VProjects portal and Android App can only be accessed by authorized users whose accounts have been setup by the Vestian team. The app also requires access to the camera so that users can upload photos for project tracking purpose.
  • The email account information from the user device is used to authenticate user. The users, as part of various project tracking features, may submit updates that include text and image information. All the information submitted by the user is used by Vestian as part of their proprietary project tracking tool.

e. Login & Website Visitation

When you visit or log in to our website, cookies and similar technologies may be used by our online data partners or vendors to associate these activities with other Personal Information they or others have about you, including by association with your email. We (or service providers on our behalf) may then send communications and marketing to these email addresses. We use RB2B, a visitor-identification service operated by Retention.com, for this purpose, and person-level identification through RB2B applies only to visitors located in the United States. You may opt out in any of the following ways: decline Analytics cookies using the Edit Preferences link in the site footer (which prevents the RB2B script from running); opt out of the Retention.com network at https://app.retention.com/optout/; or, if you are a California resident, submit a Do Not Sell or Share request to RB2B at https://app.retention.com/ccpa_details/.

2. Consequences of not providing Personal Information

If you choose not to provide your Personal Information that is mandatory to process your request, we may not be able to provide the corresponding service.

3. Data recipients, transfer, and disclosure of Personal Information:

We do not sell, trade, or otherwise transfer to outside parties your information without your explicit written consent. We may however, release your information when we believe release is appropriate to comply with the law, enforce our site policies, or protect ours or others rights, property, or safety.

We share your Personal Information within

  1. Vestian or with any of its subsidiaries;
  2. Business partners;
  3. Service vendors;
  4. Authorized third-party agents and contractors; and
  5. a successor in the event of a merger, acquisition, or reorganization of Vestian or substantially all of its assets.

We may also analyze website usage patterns in aggregate or de-identified form, which cannot reasonably be used to identify you, and may share that aggregate information with our subsidiaries and business partners for the purposes described in this statement.

Some US state privacy laws define “sale” or “sharing” broadly enough to include the use of certain cookies and visitor-identification technologies. To the extent our use of these technologies is considered a sale or sharing under those laws, you may opt out as described in Sections 1(e) and 5.

Vestian operates internationally, and Personal Information may be transferred to and processed in countries other than the one in which you are located, including the United States and India, which may have different data protection standards. When required, Vestian discloses Personal Information to external law enforcement bodies or regulatory authorities in order to comply with legal obligations.

Where the data controller responsible for your Personal Information is domiciled in the European Economic Area or the United Kingdom, transfers of your Personal Information to a country outside the EEA or UK are made only where an appropriate safeguard recognized under applicable data protection law is in place, or another lawful basis for the transfer applies.

4. Cookies and similar technologies:

The site uses cookies and similar technologies (such as session storage) placed by us and by third parties. Essential cookies necessary for the site to function, including the cookie that records your consent choices, are always active. Non-essential cookies in the Analytics and Marketing categories are set only after you consent through the cookie banner.

Cookies are small text files that we transmit via our web server to the cookie folder of the browser on your device, to recognize your device during a session and on future visits, primarily to provide a better user experience. They help us determine the frequency of use and number of users of our website.

You can review and change your choices at any time, including switching individual categories on or off, using the Edit Preferences link in the site footer.

Using your browser to control cookies

If you want to remove existing cookies from your device, you can do this using your browser options. If you want to block future cookies, you can change your browser settings to do so. Most browsers allow you to view, manage, delete, and block cookies for a website. Wherever you are located, you may contact us at info@vestian.com to ask about the Personal Information we hold about you and to request access, correction, or deletion, and we will respond consistent with applicable law.

United States state privacy rights

Depending on your state of residence, you may have the right to know and access the Personal Information we have collected about you, to correct inaccurate information, to delete your information, to opt out of the sale or sharing of Personal Information and of targeted advertising, and not to be discriminated against for exercising these rights. To exercise these rights, email info@vestian.com with the subject line “Privacy Request,” or use the cookie and opt-out controls in Sections 1(e) and 4. You may use an authorized agent. If we decline a request, you may appeal by replying to our response. Where required by law, we honor opt-out preference signals such as the Global Privacy Control.

EEA, UK, and Switzerland

If you are located in these regions, you have the right to access, correct, or erase your Personal Data, to restrict or object to its processing, to data portability, and to withdraw consent where processing is based on consent. India

Vestian adopts reasonable and appropriate security practices and procedures, including administrative, physical, and technical controls, in order to safeguard your Personal Information. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

Personal Information will not be retained for longer than necessary to fulfill the purposes outlined in this privacy statement, unless a longer retention period is required by law or for directly related legitimate business purposes. Cookie durations are listed in Section 4.

8. Children's Privacy

The site is intended for business audiences and is not directed to children. We do not knowingly collect Personal Information from anyone under 18 years of age. If you believe a child has provided us Personal Information, contact info@vestian.com and we will delete it.

Privacy practices regarding Personal Information that we collect and store about you through our portals, such as Recruitment and Alumni, will be the same as outlined herein. Vestian provides links to third-party websites and services; however, Vestian is not responsible for the privacy statements, practices, or contents of such third-party websites.

You can opt out of marketing emails at any time using the unsubscribe link in any message or by contacting info@vestian.com. We may still send non-marketing communications, such as responses to your inquiries.
